Defence lawyers for Laisenia Qarase have told the Suva High Court that they don’t agree to certain agreed facts in relation to the case.
The facts were initially agreed to by Qoroniasi Bale who has now withdrawn from the case.
Judge Justice Priyantha Fernando will make a ruling on the matter this afternoon.
Samanunu Vaniqi and Tupou Draunidalo say they have a different case theory to that developed by Bale.
Vaniqi told the court that they will be making another application for a stay.
In response Justice Fernando says this does not mean the trial will be adjourned – the application hearing will be separate from this case.
Qarase is charged with six counts of abuse of office and three counts of discharge of duty with respect to a property in which he has a private interest.
The trial proper begins tomorrow morning and at least ten witnesses are expected to take the stand.
